Terms of Service

eleme lets you build and publish websites, online shops, menus, booking pages and similar sites ("sites") from ready-made templates, at an eleme.dev address. We may add, change or remove features over time.

• You must be at least 18 years old and give accurate information.
• You sign in with your WhatsApp number. Keep access to it secure: you are responsible for everything done through your account.
• Tell us straight away if you think someone else has accessed your account.

You keep ownership of everything you put on your site: text, logos, photos, products and imported posts. You give eleme permission to store, copy, resize and display that content, only as needed to run and show your site. You confirm that you own your content or have the right to use it, including any Instagram account you import from.

You may not use eleme, or any site on it, for anything that is illegal under the laws of the Republic of Iraq or the laws that apply to you. In particular, you may not:

• sell or promote prohibited or illegal goods or services, such as drugs, weapons, counterfeit goods or stolen property;
• defraud, scam or mislead people, including by taking payment for goods you do not intend to deliver;
• publish content that is obscene, incites violence or hatred, or harms minors;
• infringe anyone's copyright, trademark or other rights, or pretend to be another person or business;
• collect people's information without a clear reason, or use it in ways they did not agree to;
• send spam, spread malware, or try to break into, overload or disrupt eleme or other people's sites;
• get around our limits, security checks or these terms.

We may review sites to check that they follow these terms. If a site breaks them, we may ask you to fix the problem, hide content, suspend the site or close your account, depending on how serious the problem is. Where appropriate, we will warn you first.

If the owner does not comply, or the activity is serious or illegal, we may act immediately and report the site and its owner to the competent legal authorities in Iraq, together with the information we hold about them. We also cooperate with lawful requests from the authorities, as described in our Privacy Policy.

When customers order, book or pay through your site, the agreement is between you and them. You are responsible for your products and services, prices, delivery, refunds and customer service, and for following the laws that apply to your business, including consumer protection law. eleme provides the tools but is not a seller, is not a party to your sales, and is not responsible for disputes between you and your customers. You must handle your customers' personal information lawfully and only for the purpose they gave it to you.

eleme offers a free plan and paid plans, with prices shown on eleme.dev. Paid plans are paid in advance for each month or year and renew until you cancel. When you cancel, your plan stays active until the end of the period you paid for. Payments are not refundable, unless the law requires otherwise. We will tell you before we change the price of your plan.

We work to keep eleme running, but we cannot promise that it will always be available or free of errors. We may pause it for maintenance or updates. Keep your own copies of important content.

eleme is provided "as is". To the extent the law allows, eleme is not liable for indirect losses such as lost profits, lost sales or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits any liability that cannot be limited by law.

You can stop using eleme and ask us to delete your account at any time (see "Deleting your data" in our Privacy Policy). We may suspend or close accounts as described in "Enforcement and reporting". When an account is closed, its sites go offline and its content is deleted as described in the Privacy Policy.

We may update these terms. We will post the new version on this page with a new date and, if the changes are significant, tell account owners in advance. If you keep using eleme after the changes take effect, you accept the new terms.

These terms are governed by the laws of the Republic of Iraq. Any dispute will be settled by the competent courts in Basra, Iraq.

These terms are available in Arabic and English. If the two versions differ, the Arabic version prevails.
